This thesis explores the legal disputes arising from price misquotations in online transaction contracts, focusing specifically on the legal nature of product pricing pages and the rescission of erroneous price indications. With the proliferation of online transactions, businesses face a significant number of consumer disputes triggered by pricing errors. This study first examines the definition, types, and relevant legal regulations of online transactions, and analyzes the formation of online transaction contracts and the legal nature of product pricing pages. The paper argues that the legal nature of a product pricing page should be determined by the type of business involved, using the completeness of the page, the company's ability to perform, and the presence of consumer reliance interests as criteria for evaluation. Subsequently, the study investigates the legal positioning of automated information systems, the effectiveness of website terms of use employed by businesses to prevent consumer disputes, and the legislative efficacy of sub-laws enacted by authorities to address these disputes. It delves into the controversies related to the formation of contracts in cases of pricing errors. Additionally, the paper thoroughly examines the legal effects of pricing errors, exploring whether businesses can rescind erroneous declarations based on civil law and the interaction with consumer protection law regulations, while incorporating comparative legal analysis. Ultimately, the thesis draws on international legislative examples and proposes preliminary suggestions for improving the relevant legal framework in Taiwan, advocating for amendments to clarify the legal nature of product pricing and error-handling mechanisms to enhance legal predictability and effectiveness.
