我國中央銀行之獨立性發展:以法制變遷史為觀點
The Development of Central Bank Independence in Taiwan: A View of the Legal History
摘要
一個國家的法律建制與發展的過程，絕對不是僅受單一因素影響的線性事件，在 歷史和國內外各方因素的影響下，我國中央銀行法制與我國建國史可謂緊密相連， 並隨著政治的民主化、經濟的自由化，歷史脈絡下的維穩政策??性與國際理論逐漸 合流，開始產生出了近代央行獨立性的意識，而有了我國今日法制的雛形。本文將我國央行法制發展變遷史作為主體，強調法制變遷過程的複雜性和法律 建制的重要性，找出影響我國央行獨立性發展之關鍵因素，探究我國不同時期引發 中央銀行法制變革的國內外政經因素為何?整體的法制發展中否存在特定之路徑 依循?本文認為，長期以來我國央行實際運作的獨立性有高於法制面獨立性保障 的狀況出現，這與我國歷史脈絡與民主發展有著重要關係。而在文章的最後，亦將詳細探討我國現今法制之獨立性問題，本文認為我國於央 行獨立性之法制保障仍有十分不足的狀況，並提出相關之修正建議與看法。

The process of legal establishment and development of a country, definitely not a linear event affected by a single factor. Under the influence of history and domestic and foreign factors, the legal system of Taiwan's central bank and the history of the founding are closely linked. With the democratization of politics and the liberalization of economy, the inertia of stability-stabilization policies in the historical context gradually merged with international theories. The consciousness of the independence of modern central banks began to emerge, and the rudiment of Taiwan 's legal system today. This study takes the history of the development of the central bank's legal system as the main body, and emphasizes the complexity of the legal process and the importance of the legal system. Find out the key factors affecting the independent development of Taiwan 's central bank, and explore the domestic and foreign political and economic factors that have triggered the legal reform of the central bank in different periods of time. Is there a specific path to follow in the overall development of the legal system? This study points out that for a long time, the independence of the actual operation of Taiwan 's central bank has been higher than the independence guarantee of the legal system. This has an important relationship with the historical context and democratic development. At the end of this research, we will also discuss the independence of Taiwan 's current legal system in detail. This paper believes that Taiwan 's legal protection of the independence of the central bank is still inadequate, and proposes relevant amendments and opinions.
