目前工程常因變更設計、驗收延遲及停工等問題而需展延工期,伴隨著工期的延長,工程保險亦隨之延期,因而產生續保費用。而目前續保費用是以「營造綜合保險各類工程參考費率及自負額表」使用說明之第十條“在其他保險條件不變之情形下,若遇有保險期間需予展延時,其展延期間之保險費,於未發生保險事故之前,可依原編列費率按展延期間與原保險期間之天數比例編列應加繳之保險費”即比例法計算續保費用。 雖有上述計算方式,但在產生續保費用後業主常以於工程契約之工程保險項目內已載明工程保險費用憑收據核實給付,並以契約該項金額為上限或剩餘工程風險已降低,不應以原合約費率續保等理由,不予給付工程展延後之續保費用或減額給付,營造廠礙於保險逾期及避免被業主暫停計價下,只能先行續保,造成營造廠權益受損,有失公平合理原則。 本研究透過文獻探討及工程實務案例探討現行營造工程保險採比例法計算營造工程保險續保費用難以合理的反映成本是正確的,有溢估或不足之狀況發生。本研究認為實有重新檢討之必要,以期續保保費能有明確且合理計算方式可依循避免產生爭議。
At present, civil engineering projects will result in renewal insurance because of the extension dispute when engineering change、delay of acceptance check、suspension of work. The calculation of renewal insurance is based on article 10 of「Contractors' all risks insurance with various types of engineering reference rates and deductible」:”In the case of other insurance conditions remain unchanged, if need to extend the insurance times, then insurance fee would be original cost multiply by a rate of extended times and original times.” It is also called proportional method to calculate the renewal insurance. When buyer dealing renewal insurance, owner thought that renewal of insurance is already contains in contract, then often reject apply for expenses from buyer. Buyer only cans renewal insurance, so as not to project stop pricing. This cause damage of the rights and interests of buyer, and it is unfair. This research through literature and engineering practice cases to proof that it’s hard to reflect the cost reasonably by using proportional method to calculate the renewal of insurance. In order to calculate the renewal of insurance more reasonable and avoid controversy, there are necessary to rehearing the calculation of renewal of insurance.
