「農業發展條例」修正經總統八十九年一月二十六日公布施行。農地政策方針由「農地農有農用」放寬為「農地農用」。觀諸條例內容,舉凡農地買賣、分割、租稅、農業經營、農地建築…等皆有重大變革,惟於立法階段之紛亂,政治妥協的結果,致使修正後之條例,有「拼裝車」之譏。 本研究擬藉由制度研究法(institutional approach)及法制研究法(legal approach)等二面向,就產生變革的背景因素來分析政策制定及執行之良窳,並分別就修法後,諸如農地地權,地用、租稅等法令規範評析,預估其對農地利用之影響,並提出相關建言,以為決策者參考。 經本文探討,就農業發展條例修正案之研析,歸納出下列幾點發現: 一、農業發展政策之調整正符合國家當前土地利用發展之需要。 二、農業發展條例係土地政策調整之重要法律,卻非唯一法制,任何土地 政策之更張,皆須全盤考量並為配套之修正。 三、本條例修正案,因壓力團體及其他民意代表政治力之介入,致政策決 策及執行績效是否確能有效改善當前農地施政問題,產生許多質疑。 四、農發條例施行後,相關作業細則或辦法,未能及時訂頒或修正,致使 基層農政、地政、建管單位於受理或執行機關申請案產生疑義。
After the amendment of "Agriculture Development Rules", our president put in into force on Jan. 26, 2000. The farmland strategy was to liberalize from "farmlands are owned by farmers and used for farming purpose" into "farmlands are used for farming purpose". Reviewing the text of all rules, there are crucial reform to farmlands transaction, division, leasing, agricultural management, farmlands building and so forth. However, due to the confusion caused at law-making stage and the outcome of political compromise, the amended rules were derided to be "cannibalized car". Via two dimensions of institutional approach and legal approach, this research is to analyze the merits and demerits of policy invention and execution based on the bachground factors of causing reform. It also deals with the analysis of the codes regulation of farmlansd ownership, use and leasing, predicts its influence over farmlands use and proposes related suggestions as the reference for decision-makers. After this research, there are following findings from the analysis of agriculture development rules amendment case. 1. The adjustment of agriculture development strategy is just complied with the land use and development of our nation currently. 2. Agriculture development rules are an important law of strategy adjustment but it is not the unique legal system. The variation of any land strategy should be considered as a whole and be an amendemnt of a package. 3. Regarding this rules amendment case, many doubts occur because pressure groups and other legal representatives got involved. Therefore, it is questionable if strategy-making and execution performance can effectively improve the farmlands implementation problems currently. 4. After agricultre development rules are put into force, related operation bylaws or methods cannot be conferred or amended in time, so agriculture administration, land administration and build standards units have doubts when accepting or executing agencies application cases.
