在經濟發展與汽車廣告之推波助瀾之下,汽車已由過去被定位為奢侈品逐漸成為一般民生必需品,在汽車佔人口的比率不斷地上升之下,若停車空間建設的速度不及汽車數量成長的速度,則可供車輛停放的停車位必然不足,許多相關的糾紛隨即產生,而停車位不足的問題在都會地區更加嚴重,依照內政部統計資料,台灣地區每2位車主只能分配到1個自有車位,公寓大廈為集體住宅,住戶們於生活上的關係較一般的獨棟住宅住戶密切,因此在使用或管理停車位上難免會發生認知上的爭議,爭訟也隨之發生。 本文先就區分所有權的基本理論、停車位產權及其管理,蒐集學說與實務見解,以期對區分所有權與停車位的產權有全面性的了解。再來針對法定停車位、自行增設停車位、獎勵停車位等三種不同類別的停車位,探討其設置的規定、停車位的產權是屬於專有或共有、停車位可否轉移給同社區之區分所有權人或非區分所有權人之第三人、停車位轉移有何限制、停車位是否可以出租給他人、有無管理上的限制、多買停車位是否可以增加土地的持有面積、停車位的買賣契約需注意的事項等議題進行探討。 再來就公寓大廈停車位制度規範及實務上爭議進行案例的整理與實際判決上的探討,期望比較現有制度與實務上的爭議之處,最後本研究再提出評析,並對未來要購買停車位的民眾提供建議。
During the economic development and automobile advertising promotion. Automobiles have been positioned as luxury goods in the past and have gradually become a necessity for people’s livelihood. With the increasing proportion of automobiles in the population, if the speed of construction of parking spaces is not as fast as the growth of the number of automobiles, the parking spaces will inevitably be insufficient and many related disputes have arisen immediately. The problem of insufficient parking spaces is even more serious in metropolitan areas. According to statistics from the Ministry of the Interior, every two car owners in Taiwan can only be assigned one parking space. Therefore, it is inevitable that there will be cognitive disputes and disputes in the use or management of parking spaces. This article collects theoretical and practical insights on the basic theory of distinguishing ownership, parking space property rights and management, in order to have a comprehensive understanding of distinguishing ownership and parking space property rights. Let’s discuss three different types of parking spaces, including legal parking spaces, self-added parking spaces, and rewarded parking spaces, to discuss their installation regulations, whether the property rights of the parking spaces are exclusive or shared, and whether the parking spaces can be transferred to the differentiated ownership of the same community Persons or non-community persons, what are the restrictions on the transfer of parking spaces, whether the parking spaces can be rented to others, whether there are management restrictions, whether buying more parking spaces that can increase the land holding area and the contract for the sale of parking spaces Matters needing attention. Next, we will discuss the actual judgment on the parking space. It is hoped to compare the existing parking spaces problem and practical disputes. Finally, this research will make a comment and analysis and will provide advice to people who want to purchase parking spaces in the future.
