汽車責任保險交通事故民事賠償金額之影響因素探討
THE STUDY ON THE DETERMINANTS OF CIVIL COMPENSATION ASSESSMENT FOR MOTOR LIABILITY INSURANCE TRAFFIC ACCIDENT
摘要
目前有關汽車責任保險交通事故的和解，常因無一定的標準評價系統作為當事人雙方談判依據，而造成雙方對於賠償金額無法即時達成共識，走入訴訟一途。本研究主要探討汽車責任保險交通事故民事賠償金額之影響因素，並綜合民法民事損害賠償規定、法院判決歷史資料實證結果建議合理的民事賠償和解金額，以提升和解成功機會，減少訴訟等社會成本。 本研究將交通事故民事賠償項目中有關法官心證認定項目如：身故慰撫金、體傷慰撫金及計算扶養費的每年扶養費數額等可能影響因素進行假說檢定、敘述統計、相關分析、複迴歸分析及決策樹等綜合分析，找出有效的影響因素及建議值。 實證結果發現在身故慰撫金的有效解釋變數為原告求償慰撫金、求償人數、法院區域、慰撫金對象、法官性別及肇責比例等六項，在體傷殘廢慰撫金的有效解釋變數為原告求償慰撫金、傷害程度、法院區域、法官性別及肇責比例等五項，並找出身故慰撫金及體傷殘廢慰撫金解釋模型、預測模型及決策樹樹狀圖，以作為民事賠償和解之依據。在扶養費的每年扶養數額計算基礎之偏好，以「行政院主計處公佈每人每年消費支出」次數最多。 最後，依本研究結果與發現，建立「汽車責任保險交通事故民事賠償和解金額試算系統」，提供交通事故當事人雙方及保險公司在和解金額上的試算使用及談判參考依據，以及未來後續研究者驗證和解金額試算系統之參考依據。

At present, there is no standard assessment tool for the persons involved of automobile liability insurance traffic accident to make compensation composition negotiation criteria, it creates both sides to be unable to achieve the common consensus immediately, but walks into a court lawsuit way. This research explores the determinants of civil compensation assessment for Motor Liability Insurance. Based on the civil law related to civil compensation stipulation and the court judgment historical material, empirical evidence results suggested the persons involved reasonable civil compensation composition amount to promote the success chance of composition and reduce legal action social cost. In this research, the compensation for mental suffering of death and body injury as well as the annual alimony amount for calculate alimony, the non-property damage - compensation for mental suffering found by case judgment principle and the case judgment principle creates different assessment by different judge’s recognition, execute hypothesis test, descriptive Statistics, correlation analysis, multiple regression analysis and classification and regression tree analysis. Through these synthetic analyses, it finds significant determinants and value recommended for above three judge’s recognition compensation items. Eempirical evidences reveal the following results: There are six significant determinants for the compensation for mental suffering of death like demanded amount, demantant’s number, court area, demantant’s identity, gender of the judge and liability ratio. There are five significant determinants for the compensation for mental suffering of body injury like demanded amount, injury degree, court area, gender of the judge and liability ratio. Moreover, it creates the explanatory model, predictor model and decision-tree graph of the compensation for mental suffering of death and body injury as the reference for compensation composition negotiation. The preference of the annual alimony amount for calculates alimony is the expenditure amount per peason per annum released by the Directorate General of Budget, Accounting and Statistics (DGBAS) of Executive Yuan. Finally, it builds a trial calculation system for civil compensation composition assessment for motor liability insurance traffic accident according to the research result. The trial calculation system will provide the insurance company and the persons involved the decision-making criteria when taking compensation composition amount adjustment or action. Furthermore, it will provide the reference for future researcher verify the accuracy for the trial calculation system.
