摘要

本研究係針對員警涉犯與販毒相關之貪污犯罪類型及白領犯罪過程機會理論（Benson等,2009）深入研究，彙整近年相關案例，分析其犯罪手法，並從中歸納出「寄生於合法職業過程中之犯罪機會(節點)」，以提供相關單位切斷制度中之「犯罪機會」，並且研擬監督及防制對策之參考。本研究之研究方法係以深度訪談法進行，訪談對象為受刑人、警務正、檢察官及調查官等4位受訪人，研究結果發現，員警涉犯與販毒相關之貪污犯罪之特性共有下列3項：
一、涉案員警與毒犯熟識且關係複雜，有跡可尋。
二、查緝毒品執法作為難以全程透明。
三、員警涉入貪污販毒先有共生關係，保持平常往來，犯罪發動則視時機而定。
寄生於合法緝毒作為過程中之犯罪機會有下列4項：
一、線民佈建。
二、線上查詢系統。
三、臨檢及搜索作為。
四、尿液檢體採集過程。
本研究提出防制員警涉犯貪污及販毒行為之策略如下：
一、線民佈建應回歸法制規範，不宜便宜行事。
二、線上查詢系統需強化不定期抽檢。
三、臨檢或搜索作為應全程錄影，並備份備查。
四、採集毒犯尿液檢體流程需全程錄影，紀錄應由專人保管，證物室需設置門禁。

This study researchs the policeman who involved in drug related corruption and white-collar criminal process opportunity theory (Benson et al., 2009).This study aggregates related cases,and analyzes its modus operandi to summarize the criminal opportunities (node) parasited on the legally professional process.This study trys to provide the reference of supervision and control strategy for the relevant units to cut off the criminal opportunities in the system.This study adopts depth-interview method to discuss with prosecutor,police officer,prisoner and investigator.The results find the characteristics of policeman involved in drug related corruption are following three points:
1.The relationship between involved policeman and drug traffickers are familiar, and the complex relationship can be traced.
2.The entire process of drug enforcement is difficult to be entirely transparent.
3.First,the policeman involved in drug related corruption has a symbiotic relationship with drug trafficker , and they both maintaine normal contacts.When to makes crime is depended on the proper timing.
Four illegimate opportunity structures are parasitic on the legimate drug enforcement activities which include:
1.nark provisioning.
2.online inquiry system.
3.rummage and search act.
4.urine sample collection process.
This study presents prevention strategies for the policeman who involved in drug related corruption as fallows:
1.Nark provisioning norms should return to the rule of law, and should not be abused.
2.Online inquiry system needs to strengthen occasional sampling.
3.Rummage or search act should be record entirely and backup for future reference.
4.Drug trafficker urine specimen collection process requires full monitoring, the records should be kept by the particular person,the access to evidence room should be set.
