摘要
「酒駕」一直以來是世界各國嚴重的社會治安問題，各界要求重懲的呼聲不斷。儘管對於「重刑化」的手段是否會有效達到降低酒駕事件發生的效果，不無疑問，但就目前我國立法趨勢而言，法定刑有逐步加重的傾向，立法者仍然試圖藉由「加重處罰」平息人民對於酒駕危害的恐懼。 為遏阻酒駕惡行，各國無不祭出重罰以為因應。在美國，除了針對酒駕主要行為人進行懲處之外，也將酒類供應商納入責任對象的範圍之內，擴大歸責對象的適用。鑑於美國長年以來對於酒精飲料控管的經驗，本文首先瞭解美國酒類供應商責任完善侵權責任體系，針對其構成要件依序作說明，並其中以特定州的立法規範作具體介紹。 在參酌美國酒類供應商責任法下，本文將嘗試以美國法作為借鏡，在我國現行立法下，尋找刑法以外的途徑來解決酒駕的問題。將美國替代責任與我國代負責任進行分析，並且探究美國酒類供應商責任法於我國民法適用上的可能性。本文認為將酒類供應商責任法納入我國立法規範，得以創造我國安全無虞的用路環境，並同時給予被害者最大獲得金錢補償可能，兼顧個人和整體社會之利益。

"Drunk driving" has always been a serious social problem in various countries around the world. A howl of protest is a cry for more severe punishment. However, there is no evidence showing that the "heavier penalties" approach will effectively reduce the incidence of drunk driving incidents, as far as the current legislative trend in Taiwan is concerned, the statutory penalties tend to gradually increase, and lawmakers still try to calm people's fear of the danger of drunk driving. In order to curb the trend of drunk driving, all countries have offered heavy penalties in response. In the United States, in addition to punishment for the main tortfeasor of drunk driving, alcohol suppliers are also included in the scope of the object of responsibility, and the application of the object of liability is expanded. In view of the long years of experience in the control of alcoholic beverages in the United States, this article first introduces the Dram Shop Act which regulates the liability of the US alcohol suppliers, the elements of each state law regarding to the Dram Shop Act. With reference to the US Dram Shop Act, the article then examines the related regulations in Taiwan. Besides the criminal law, it is possible to seek other ways and solutions to solve the problem of drunk driving. This article analyzes the US vicarious liability and civil torts law system in Taiwan, and explores the possibility of applying the US Dram Shop Act to our civil law system. Given that drink drinking is a considerable social issue in Taiwan and that no effective measures have been put in place in recent years to improve the problem. Incorporating the US Dram Shop Act into Taiwan’s legislative norms can create a safe road environment and also give the victims the maximum possible monetary compensation, and take into account the interests of individuals and the society as a whole.
