本文係以桃園市某國中發生的三個網路霸凌事件為對象,透過深入訪問網路霸凌個案當事人、家長、導師以及學校行政人員,了解三組網路霸凌個案的處理過程與相關人員對於處理的看法,藉以剖析學校對於網路霸凌事件的處理方式,以及處理過程影響處理成敗的因素,而有下列的研究發現:一、網路霸凌是一般校園霸凌的延伸,但散布範圍廣,匿名酸民趨向刻薄的言語攻擊,對被霸凌者往往造成更嚴重的身心傷害。二、網路世界比現實世界更容易留下霸凌事證,但霸凌者往往不知行為已經觸法。三、影響網路霸凌事件處理成敗的因素有四,霸凌者的動機、家長的管教功能與處理態度、親師關係良窳及當事人是否信任校方處理人員等。因應上述研究結果,本文提出下列建議:一、以去標籤化的校園網路霸凌觸法個案進行法律教育,讓學生了解網路世界凡走過必留下痕跡,無事實根據的造謠與尖酸言語文字的攻擊而侵害人格權,極有可能觸犯公然污辱或誹謗罪。二、透過高風險家庭通報系統,提供有償的親職教育輔導來培養高風險家庭的正向管教知能。三、當事人導師應為處理小組的當然成員,當可強化校方處理小組對雙方當事人的了解,以及被雙方當事人所信任接受。當然,班導師必須關心學生並獲得學生及家長的信任為前提。
This study focuses on three cases of cyberbullying incidents in a junior high school in Taoyuan City. Through in-depth interviews with the perpetrators, victims, parents, advisors, and school administrators involved, the study examines the handling processes of these cyberbullying cases and the perspectives of the individuals involved. The aim is to analyze how schools handle cyberbullying incidents and the factors influencing the success or failure of their interventions. The research findings include: 1. Cyberbullying extends the scope of traditional campus bullying, often involving anonymous users who use harsh language, causing severe psychological and emotional harm to the victims. 2. The online world tends to retain evidence of bullying more readily than the physical world, yet perpetrators often do not realize their actions may be illegal. 3. Factors affecting the handling success of cyberbullying incidents include the motives of the bullies, parental disciplinary attitudes and handling approaches, the quality of parent-teacher relationships, and whether the involved parties trust the school's handling personnel. Based on these findings, the study proposes the following recommendations: 1. Provide legal education on cyberbullying cases that avoid labeling, emphasizing that actions like baseless rumors and malicious verbal attacks online can violate personal rights and potentially constitute defamation or public insult. 2. Implement a high-risk family notification system to offer paid parenting education and counseling to enhance positive parenting skills in high-risk families. 3. Ensure that the student's advisor is a natural member of the handling team, enhancing the team's understanding of both parties involved and ensuring trust from the victims and perpetrators alike. Advisors must prioritize student welfare and establish trust with both students and parents. This study aims to contribute insights into improving school responses to cyberbullying incidents, fostering a safer online environment for students.
