摘要

本文係討論現存於山坡地管理裁罰實務上三項較具爭議的法律問題，即關於裁罰對象、重複處罰和限期改正等問題。對於前述問題，現行水土保持法之相關規定其實並未周延，而行政執法機關與行政法院裁判彼此所持之看法亦存有歧異，造成執法上嚴重困擾。為解決實務上之棘手問題，本文一方面將分析說明雙方各自的看法並檢討其中的差異之處，另一方面，則嘗試從行政法學理出發，深入分析前述問題，之後則提出個人相應建議，以供執行機關參考適用之，期使水土保持管理工作日後能順利推行。

This article focuses on the three of the most controversial legal issues about the punishment and management of slopeland in the practice, including ”the subject of the punishment”, ”double jeopardy” and ”curing with prescribed time limit”. According to the issues above, the current Soil and Water Conservation Act is not perfect, the administrative enforcement institution and the administrative court also have different opinions about these issues, all this results in a great amount of confusion when enforcing the law. In order to solve the problems in the practice, this article is going to analyze and review the differences between each other, also going to research these issues with administrative law, and to trying to give personal recommendation in order to make the management of soil and water conservation becomes more smoothly in the future.
