駭客倫理與新敎倫理:作為西方法律文明的再現

Ethics of Hacker and Ethics of Protestant: As the Representation of Western Legal Civilization

摘要


「駭客」往往網路犯罪的代名詞,但是由海莫能的正名,不僅僅是網路英雄,他們的工作態度更是現代社會的最佳倫理,或許可以這麼說,海莫能認為駭客倫理就是代社會倫理基礎,同時海莫能也認為駭客倫理是新敎倫理的延續與再生。但是海莫能的努力,就本文而言尚有再詮的空間,必須再深入理解,特別是重新再理解韋伯的新敎倫理。本文認為駭客倫理不僅僅是新敎倫理的延續,更是西方法文明的青現(representation),不僅重視自律的工作勤奮,不排斥享樂與累積財富,駭客倫理也十分重視權利請求與合理化理性言說。

並列摘要


Most of people are used to thought hacker as the criminal in network society, but Himanen thinks it is a prejudice. In his view, ethics of Hacker is the continuation of the ethics of Protestant, and represents the spirit of modern society. He even thinks Hackers are the heroes in the network world. I agree most of the Himanen’s view about the relation between hacker and Protestant, but it still worth to interpret more deeply. This paper tries to interpret ethics of hacker is the representation of Western legal civilization, which is a complexity of self-control, claim of right, and rationalized logos.
