我國電腦犯罪曁偵防對策之研究

摘要

二十一世紀是資訊化的時代，電腦網路帶來的是人類科技典範的轉移，這是繼機械革命後，影響人類生活最大的一項發明，迄九十一年三月，國內上網人口已隨著電腦資訊與網際網路快速發展而接近800萬人，惟隨著電腦網路的發達，利用電腦或網路進行之不法行為，也有逐漸蔓延的趨勢，不但犯罪數目急遽增加，犯罪手法也不斷翻新，影響範圍擴及社會的各個層面，所以電腦一旦遭有心人士惡用，其對國家社會所造成的傷害將是不堪設想，政府有鑑於此，於九十年一月成立由行政院院長親自擔任召集人之「國家資通安全會報」，以強化政府資通安全防護、建立全民防護體系為目標，惟政府立意雖好，然成效仍未見彰顯，是以本文中，筆者擬從，犯罪偵防觀點為出發，對電腦犯罪定義與特色作一初探並提出偵查與預防之道，以供犯罪偵查實務界參考，並期能達拋磚引玉之效，讓更多的人共同重視此一嚴肅議題。

Following the mechanic revolution, the 21st century, a computer era, comes with it another human technology revolution land brings a high impact on human life. With the advent of cyber space, as of March 2002 there are close to eight million Internet users in Taiwan, which is indeed a big population.
With the coming of computer internet, sadly to say, the number of computer crimes is also increasing and prevailing in this island. Therefore, if hackers take advantage of the computer information system, the damage on humanbeings will be beyond our expectation.
Considering the above problem, the Executive Yuan established the National Information and Communication Security Taskforce on January 2002, which is leaded by the Premier, to strengthen the government information security management system and to build up a national computer shield system to get rid of all possible hackers. Though much effort has been done, yet so far it doesn't work out very well.
In light of the shortcomings of above government computer program and in order to safeguard the cyber space, the essay hereby will deal with the issues of computer crime, its prevention and investigation. And wish it might spotlight the issues worth our considerations when we crack down on the computer crime.
