依賽門鐵克(Symantec)統計在2004年8月到10月間,全球約有66%的電子郵件為垃圾郵件;Sophos統計則顯示截至2004年9月,全球因垃圾郵件所造成的損失有1,310億美元,垃圾郵件佔電子郵件比例相較於去年同時期,已成長了兩倍。隨著這些不請自來、匿名造訪的垃圾郵件,除可能因大量郵件而造成網路服務提供者之伺服器癱瘓外,郵件所夾帶的病毒也會造成企業的傷害。由於垃圾郵件問題日益嚴重,國際間除尋求科技解決措施外,透過法律規範來遏止垃圾郵件氾濫已成為趨勢,如歐盟各國、美國、澳洲、日、韓等國皆已完成垃圾郵件管制規範。我國亦由通訊傳播委員會籌備處於2004年6月間完成「濫發商業電子郵件管理條例」草案,目前正在行政院審議中。本文擬介紹歐美澳等國垃圾郵件法案之執行概況,與我國刻在審議草案之規範,並於文末提出我國垃圾郵件管制規範之建議。
Symantec officials said spam volume held steady at 66 percent between August and October this year. Sophos statistics show that 2004 alone to September, global spam has caused an estimated cost of USD 131 billion and that volumes have doubled compared to this time last year. Besides those unsolicited, no-name and bulk emails shut down the servers of Internet service providers; the virus attached in emails would incur company's damage. Because Spam is getting more serious, in a regulation manner, except technology solutions, to stop Spam becomes a trend. Spam regulations in many countries, like U.S.A., Australia, Japan, Korea, have been enacted. The preparatory Communications Commission has drafted ”Controlling the Abuse of Commercial Email Statute ”in July of 2004 in Taiwan. The draft Statute is pending in Executive Yuan now. This article will introduce our draft Statute and an implementation in Europe, America and Australia after their spam acts enforcement. At the end of this article, we would like to provide some recommendations about Spam regulation in Taiwan.
