行政法人績效管理的探討

Study of Administrative Performance Management for Non-departmental Public Body

摘要


「行政法人」制度為一種新建置的公務組織新型態在提升政府施政效能及效率的同時,亦能確保公共任務之妥善實施。其因負有公共任務之實施,攸關民衆利益,因此,如何建立一個嚴謹、明確、具效益的監督管理及績效評鑑機制,實為重要之課題,且藉由績效評鑑機制的建立,評鑑行政法人目標是否適切達致,符合設立之意旨,方能達到建立一個創新、彈性、有應變能力的政府,提升政府施政效能與國家整體競爭力。 本文針對行政法人之意義及定位做簡要說明,並與財團法人之差異作一比較,次就行政法人績效管理制度的精髓-行政法人績效評鑑機制之規劃做一探討,且簡要討論國立中正文化中心績效評鑑制度的建置,其中並參酌德國新治理模式、英、美國新公共管理的績效管理及評估、及日本獨立行政法人績效評價機制及公司治理概念,以做為我國建立行政法人績效管理機制之借鏡。最後,綜合本文分析及探討,謹提出5點建議:一、治理結構的設置及功能宜再妥善研議;二、提升行政法人資訊透明度,加強內部稽核;三、增強回饋及激勵機制;四、監督機關應訂定發展目標之指示,且評鑑委員會宜適時參與相關決策;五、加強溝通協調及建立相關管道,俾作為未來政府推行行政法人績效管理之參考。

The ”non-departmental public body” is a new organization designed to improve the efficiency, and effectiveness of the government to ensure that public affairs are conducted properly As the organization is responsible for public affairs which are closely elated to the rights and interest of the citizens creating a reliable accurate and effective management and performance assessment system becomes an important factor influencing the success of the organization. With the establishment of a performance assessment system, we can evaluate if the goals of the ”non-departmental public body” are appropriate and consistent with its mission. Only then, we can create an innovative, flexible and responsive government and improve our national efficiency and competitiveness. This article will focus on two topics-the definition of a ”non-departmental public body” and the establishment of an effective performance assessment system. First, we will discuss the meaning and functions of a ”non-departmental public body” and compare to that of a ”non-profit organization”. Secondly, we will study the performance assessment system for ”non-departmental public bodies”, discuss briefly the performance assessment system of National Chiang Kai Shiek Culture Center, consult the new governance model of Germany, performance management and evaluation system of the new public management of the United States and the performance management system of Japanese independent ”non-departmental public bodies”. Introduce the structure and mechanism about ”Corporate Governance”. We will propose five suggestions based on the analysis and studies as mentioned in this article: 1. The governance structure of ”non-departmental public body” should be well set. 2. Improve the information transparency of ”non-departmental public bodies” and enhance internal inspection function. 3. Strengthen the reward and incentive mechanism. 4. The supervisory agency should establish goal indicators for development and enhance functions of the evaluation committee. 5. Enhance communication and coordination functions and create relevant channels. These suggestions shall serve as reference for the government when initiating the performance management of ”non-departmental public bodies”.
