摘要

政府資訊公開法已於2005年12月28日公布施行，為行政院推動之重要法案之一，施行迄今年餘，於實務運作時首須了解並落實本法之規定。本文以探討本法主要規定包括應主動公開之政府資訊、豁免公開之政府資訊、實務運作程序及救濟為主，兼論與其他現行規定之因應適用及檢討法制實務。

The Freedom of Government Information Act was promulgated and enforced since December 28, 2005. It is essential for government entities to understand and integrate the Acts regulations in their day-to-day operations.
The purpose of this article is two-fold: Firstly, it explores the major regulations of the Freedom of Government Information Act, regarding the active disclosure of Government information, allowed exemptions from disclosure, operating procedures, and appeal processes. Secondly, the article discusses the Act's application in tandem with current laws, and reviews the Acts operation in the current legal system.
