台灣地區國家公園管理法規之競合探討

摘要

一個風景區之管理趨於完善，取決於三大條件：（一）管理計畫（二）管理機構（三）完備之法令系統。台灣地區國家公園無論劃設目標、規劃建設與管理體制，已在近年內邁步推展並獲顯著之成果；然而地小人稠的台灣島，往往土地利用計畫疊床架屋，國家公園內若發生資源保護與利用衝突之事件，常必須引用國家公園法及其他相關法規解釋之。所發生之併存關係必須靠「競合」方能開創環保新機。本文除了對我國國家公園法提出立法說明外，對於相關管理法規分類後，嘗試提出三項法規舉例競合探討：（一）國家公園法與區域計畫法、都市計畫法（二）國家公園法與野生動物保育法（三）國家公園法與森林法，藉以拋磚引玉，激起更深入之國家公園法規研究。

The development of Taiwan's National Park has played important roles for the natural conservation in this island. With about the highest population density in the world, Taiwan has faced the increasing pressure for the development of the natural resources. In order to prevent overuse of the natural resources, the government have put many efforts to protect the environment during last decade. These efforts include the establishment of protected areas, such as national parks, forest reserves, wildlife sanctuaries, coastal protection areas, etc., as well as the legislations for the rational land use through the regional plans and urban plans. However, there are some conflicts exsisted among different regulations which are ”co-exsist” on a same piece of land when different agencies apply for different management objectives. Hence, this study aims to classify the objective of all relevant conservation regulations, to clear up the suitable applications for each regulations, and try to find out the solutions for the exsist conflicts, The target regulations for this study include National Parks Law, Regional Law, Regional Plans Law, Urban Plans Law, Forest Law, Wildlife law, and so on.
