從天人關係考察《荀子》的「法」思想：以出土黃老思想文獻的對比分析為中心

摘要

黃老、《荀子》兩者所呈現之「法」思想，取向各具特色，但其理路又非截然不同。大體言之，黃老與荀子之法思想，關注所在，乃是對於重建政治秩序的討論。只是兩相對照，前者主要表現於承天行治的立場，後者則側重具體的人間經驗，開展法的倫理性格。兩者雖對於天人關係之看法不同，然細繹其說，其法思想脈絡卻又相互接引。而向來對於黃老與荀子之學的探討，大都侷限在傳世文獻的對較當中，甚少對出土黃老思想文獻有深入地探討。即緣此故，筆者將以上博楚簡〈三德〉、黃老帛書四種之分析為起點，注目有關天人關係的論題，嘗試提出《荀子》法思想的特色，再比勘其與黃老法思想之殊異，期以得見先秦政治思想的開展方向。

＂Fa＂ in Huang-Lao and Xunzi differs in characteristics but share similar orientations. In short, both focus on how political orders ought to be reconstructed: the former stresses ruling in accordance with the will of heaven while the latter emphasizes concrete human experiences and further extends to ethical character of Fa. Although differing in relation between heaven and human, the two are interrelated with, if observed closely, philosophical contexts. The constraint of past research on Huang-Lao and Xunzi lies in its academic limit of comparison of literature of later generations and lacking further discussion on the original text of Huang-Lao. Hence, the article begins with an analysis on Shangbo Chujian (Sande) and Huang Lao boshu, focusing on the discussion of relation of heaven and human in order to address Xunzi's Fa, whose differences will also be compared with Huang- Lao, in order to examines the development of political thoughts in Pre-Qin Era.
