中共「高等教育法」之研析

摘要

中共在制定「中華人民共和國義務教育法」、「中華人民共和國職業教育法」、以及「中華人民共和國教育法」之後，又於一九九八年八月通過立法而推出了「中華人民共和國高等教育法」，並訂於一九九九年元月一起正式實施。自此，大陸正規教育層面的法律體制大抵趨於完備。唯大陸教育法制層面有待填補與完善的事項難於短時間內配置齊全。易言之，大陸教育層面法治化的推動仍是障礙重重。誠然，「中華人民共和國高等教育法」的制定有其一定的特色，但是該法未能妥善處理條例中兩項主要課題，是為美中不足者。

Following the Compulsory Education Law and the Law of Education of the People's Republic of China, the PRC's national assembly passed the Higher Education Law and which went into effect on January 1st, 1999. The legislation system of the formal education in mainland China has thus integrated, which indicates a coverage of the elementary, secondary, tertiary, and occupational levels of education. However, the legislation is still not complete, especially in terms of its execution and nor will it be equipped fully in the foreseeable future. Thus this law should be considered a general hindrance to the public. Moreover, we may expect the law undergo serious revision sometime in the future.
