法律作為文化精神的社會建構物:論勞思光先生晚期文化哲學的法政思想

Law as Social Construction of Cultural Spirit: On Lao Sze-Kwang's Late Cultural Philosophy of Law and Politics

摘要


勞思光先生將建構中國全面式的文化理論,視為晚年唯一的著作計畫。筆者透過勞先生晚年的著作,梳理出有關文化哲學的法政哲學思想。筆者主張,我們從勞先生的文本可以清楚推知,他將法律視為文化精神的社會建構物。不過,有關文化的雙重結構或文化系統的開放性成素等概念,僅能處理異質文化之間溝通互動的可能性情況,僅能解釋中國文化精神何以能產出現代性的民主與法律。但是筆者強調,將法律視為文化精神的社會建構物,無法積極解決世界文化的危機與跨文化之間的整合問題,因為其自身的民主正當性與合理性仍需要被檢驗與證成。因此筆者建議,我們可以援引Habermas的法律論評理論,使作為文化精神建構物的法律,得以進一步成為解決世界文化危機與跨文化整合的溝通媒介。

Lao Sze-Kwang regards the construction of a comprehensive Chinese cultural theory as his only work plan in his later years. First, I sort out the legal and political thought Lao Sze-Kwang's late works on cultural theory. And secondly, I claim that we can make it clear from Lao Sze-Kwang's late texts that he regards law as a social construction of cultural spirit. However, Lao Sze-Kwang's conceptions such as "dual cultural structure" or "open elements of cultural system", can only deal with the possibility of communication and interaction between different cultures, and it can only explain why the spirit of Chinese culture can produce modern democracy and law. But the author emphasizes that "law as a social construction of cultural spirit" cannot actively solve the problems of the crisis of world culture and the integration between different cultures. Because its own democratic legitimacy and rationality still need to be verified and justified. Finally, I propose that we can invoke the Habermas' discourse theory of law, and make it possible to further transform the "law as a social construction of cultural spirit" into "law as a communicative medium" to solve the problems of world cultural crisis and cross-cultural integration.
