摘要

建築資訊模型（BIM）在世界建築業的應用，最近幾年進步非常快。本研究旨在蒐集歸納國外有關建築資訊模型之法律課題，並檢討分析我國應用BIM之可能法律問題，供建築業及其相關產業人員在發展BIM商業模式及擬訂工程契約時，能建立正確的觀念減少誤用的可能，期能積極充分發揮BIM的功效。本研究從文獻中以歸納法，將BIM的法律議題做分類。再針對這些議題，進行法律分析與討論。研究結果發現目前我國法制環境下，導入BIM仍有一些工程法律課題尚待進一步釐清，建議導入者在制定有關契約應就這些法律議題予以考量。

Building Information Modeling (BIM) has undergone rapid advancement across building industries worldwide in recent years. This study compiles legal issues on BIM applications in other countries and analyzes possible legal issues in its implementation in Taiwan. The goal is to maximize the efficacy of BIM by equipping building managers with correct principles and minimize misconceptions in their development of BIM business models and preparation of construction contracts. We use induction approach to identify possible legal issues from literatures. We then analyze and discuss each of these challenging issues. Study results reveal that there are several issues yet to be clarified in implementing BIM under current Taiwan's legal system. Those responsible for such tasks are advised to give these issues due consideration when incorporating BIM in construction contracts.
