According to article 4 of the Trade Union Law, teachers, government employees, and workers in munitions factories are prohibited from organizing a union. Hence, Taiwan teachers can not form unions to improve working conditions for decades. Although, the Teachers' Law, promulgated in 1995, provides teachers with the right to organize the association. But the association does not have collective bargaining and dispute right. It only have some consultation and participation opportunities. In fact, the right of public employees to organize and join unions is protected by Constitution and statutes in developed countries. According to the Survey of members of executive council and board of supervisors at regional level teachers' associations, by mail questionnaires, also indicate that most of members support the right to form unions for teachers. For this reason, this study suggests that Teachers' Law should be amended to allow the teachers' associations to have collective bargaining and dispute right. At the same time, the teachers' associations in Taiwan should take both the professionalism and unionism approach.
