公私合夥的衝突與管理-促參法制度性爭議案例解析

The Conflicts and Management in Public-Private Partnerships: Cases of Act for Promotion of Private Participation in Infrastructure Projects

摘要


公私協力夥伴已成為諸多國家推動經濟發展的重要政策工具。本文旨在探討我國促參法施行以來,對於政府機關與民間機構建立公私協力夥伴關係卻為何衍生出爭議問題。對此,本文從治理與法律對於公私協力夥伴的認知和見解切入並比較,檢視促參法及其合約的制度屬性,以及治理機制等三部分檢視相關文獻。研究方法以因果程序追蹤的個案研究,彙整ETC、大巨蛋、阿里山森鐵與大鵬灣等爭議事項,分析其問題癥結與爭議類型。研究發現促參法制度性爭議案例類型可歸納為投標審議階段落選的競爭者提出訴訟、行政機關單方面介入干預、簽約兩造面臨不可抗力之情事、以及廠商提前終止契約等情況。而之所以造成上述爭議在於理論與實務對於協力夥伴認知不一,司法機關對促參法契約性質有私法、公法與雙階性等三種見解,進而增加公私協力夥伴發生衝突的可能性與管理的不確定性。

Public-Private Partnerships (PPPs, P3s) have become a prominent policy tool in public governance and for public infrastructure projects to boom economic prosperity in many countries, such as Taiwan, South Korea, Japan, and Singapore. This article discusses the conflicts and management in PPPs and adopted case studies to explore what factors cause disputes between the public sector and the private sector. For this purpose, the paper addresses three causal variables: the nature of P3s, the institutional attribution of Act for Promotion of Private Participation in Infrastructure Projects, and interactive strategies for contractual partners. The causal variables pass by the causal mechanism (the mechanism of private participation) to affect the outcome variable, the cases of PPPs. The author analyzed four dispute cases and the possible conflict between the partners, the uncertainty of management and suggested recommendations in P3s.
