摘要

1996年4月5日下午4時26分國華航空B-12257多尼爾型客機，於馬祖機場降落時，不慎失事墜海，乘客五人罹難，一人失蹤，其餘包括正副駕駛在內十一人，幸運逃過一劫，失事原因經民航局調查判定爲人爲疏失，導致此起意外。
本文從醫學角度切入，由驗屍報告，傷情分析，逃生經過，到航空醫學研判，進一步探討人爲因素的分析。由於正副機師遭到金門地檢署檢察官以過失遺棄罪起訴，失事調查結果是否可作爲司法審判、起訴機師的依據？文中提出相關四個案例，以供相關單位參考。

On April 5th, 1996 afternoon, at 4:26Pm, the Formosa airlines B-122S7, when landing carelessly, dropped into the sea. Five passengers died, one missing and the rest eleven passsengers including the pilot and co-pilot luckily survived. Civil aviation investigation determined that it was pilot's error that cause this accident.
Intruding from the angle of medical studies, from autopsy report, injury pattern analysis, escape procedure, to aviation medical study and judement, this essay makes a further evaluation in analysing human factor. As the pilot and co-pilot face court prosecution for the offense of abandonment by procurator at Kin Men, the conclusion of this investigation, could it be made according to the prosecution of the pilots? This essay provides four related cases for reference.
