摘要

由於電腦使用之普遍，電腦軟體之保護於智慧財產權領域中，不僅引起產業界之注意，同時也產生了諸多之爭議。新著作權法雖將電腦程式列入保護之規定，但由於電腦科技發展快速，電腦軟體及其相關保護問題也千變萬化、層出不窮，以致法規無法周延地予以保護。故本文之目的乃在探討新著作權法法規所可能產生之爭議，並參考世界主要國家對電腦軟體保護之法規，就我新著作權法所產生之爭議問題提出一解決之建議。

Owing to the university of the computer, the protection of the computer software becomes more and more important in the field of intellectual property right today. Although the new amended Copyright Act regulates the computer program as the object within the copyright protection, there are still a lot of issues regarding the law of the computer.The purpose of this paper is to explore the probems concerning the protection of the computer software in the new amended Copyright Act and make recommendation for solving those problems by comparing with the statutes of the leading countries in the world.
