摘要

「智慧財產權」係指人類精神活動之成果而產生財產上之價值者，由法律所創設之一種權利。然而「著作權」是「智慧財產權」的一種，本文將對於圖書館中「著作權」的範圍及定義做進一步探討，在針對智慧財產權保護及資訊傳播者所應扮演的角色及定位，並討論台灣加入WTO對於圖書館未來發展及影響，藉以提升圖書館的專業地位與其正常之運作。

Modem libraries should rethink its position as an information disseminator in the wake of intellectual property rights which bestows legal rights to owners of intellectual properties. This paper discusses the scope and definition of intellectual property rights in the context of library functions. The impact of WTO on library is also discussed to ensure that libraries operate efficiently and professionally.
