市地重劃制度對區域影響:以臺中市整體開發地區自辦重劃為例

Urban Land Readjustment Policy and Regional Impacts: Readjustment by Private Sector Effect in Taichung City

摘要


本研究旨在以臺中市整體開發地區為例探討自辦市地重劃制度缺失及重劃過程對區域變遷及影響為何,並由案例經驗提供建議以減少未來政府推動市地重劃糾紛。臺中市自2004年解除後期發展區發展禁令後,釋放一千四百三十七公頃土地範圍劃分十四個單元進行市地重劃,其中市地重劃分別是由九個自辦重劃單元與兩個公辦重劃所組成,其中自辦重劃過程產生許多爭議。包含土地所有權同意重劃爭議、抵費地爭議、自拆獎勵與文化資產保存爭議等…,使得弱勢居民遭受制度所壓迫。同時受到大範圍開發,自辦重劃區域特性也將受到改變而成為新的都市空間。本研究以質性研究為取徑,研究時程為2013年4月至2014年1月透過深度訪談、參與觀察與次級資料為資料蒐集方法,訪談過程包含在地居民、政府官員、開發單位與地方文史工作者。本研究結果依據臺中市自辦重劃歸納不同重劃階段所產生的爭議,同時探討自辦重劃下土地變遷背後所蘊藏的社會問題,最後本研究藉由不同重劃階段所產生的糾紛提出具體建議以減少未來政府辦理自辦重劃時的糾紛。

Through a case study of the 3rd overall urban development area in Taichung City, this research provides suggestions for land use policy to minimize the conflict between urban development and the rights of citizens in the future. Taichung city government started the land readjustment project in 2004. There are fourteen readjusted units within the overall development area, which includes nine privately held units and five units in the governmental sector. Although land readjustment is a method to solve the land use problem and support urban development, it nevertheless poses disadvantages. Significantly, there are many controversial issues, such as the unequal distribution of readjustment bonuses and offset expenditures, land usage, and the preservation of historical and cultural heritage, in the private development sectors of the 3rd overall urban development area. This research uses qualitative methods, including interviews, participant observation, and the analysis of secondary data. Interview participants included real estate developers, government officials and local residents. To conclude, this study provides recommendations for land readjustment in different stages of development to ameliorate problems and conflicts associated with future urban development in the future.
