同志家庭與兒童人格發展之交織

摘要

隨著社會風氣日漸開放，對同性伴侶關係，漸持正面友善之態度，惟同性父母是否適任「最適父母」，擔負起保護教養子女之責，始終正反意見紛歧。反對意見者認為，子女應於「一男一女」所組成之一夫一妻家庭中成長，若兒童由同性之父或母撫養，將影響子女性別認同之自我建構，易使兒童發生性別混淆，有礙兒童人格發展。反之，採贊同之立場者，則認為所謂「最適父母」，是否限於「一男一女」所組成之異性戀家庭，不無疑問，社會存有同志家庭之事實，不容否認，不宜陷入「異性戀霸權」之漩渦中。又無確切科學證據足以證明，同志家庭將對兒童產生不良之影響，且同性父母亦能成為「最適父母」，提供兒童成長之所需，故兒童由同性伴侶撫養，未必不利於兒童之人格發展，亦未反於兒童最佳利益。是以，本文欲探究雙親之性傾向與兒童之人格養成是否具必然之關連性，採取文獻分析法，分析相關文獻與法院裁定，以釐清擔負起保護教養兒童責任之雙親，其性傾向於判斷兒童最佳利益上，是否扮演關鍵性之角色。雙親能否提供良好之成長環境，為兒童健全人格發展之核心，父母之性傾向則非重點。期以建構性別意識、性別友善之環境，俾利於同志家庭去汙名化，並肯認同性父母之「最適父母」之地位。

With the increasingly open social atmosphere, the same-sex couples are held a positive and friendly attitude. Whether the same-sex parents are eligible for ＂excellent parents＂, to take responsibility for the protection of children, always positive and negative views. Objectors believe that children should grow up in a normal family of ＂on man and one woman＂. If children are raised by the same-sex parents, will affect children's gender identity of self-construction, easy to make children sex confusion, and impeding personality development of the child. On the contrary, assentients think that the so-called ＂excellent parents＂, whether limited to ＂one man and one woman＂ composed of heterosexual families have question. Social existence of the same-sex marriage of the facts can't be denied. Shouldn't fall into the heterosexual hegemony in the whirlpool. There is no definite scientific evidence to prove that the same-sex marriage will have an adverse effect on children, and the same-sex parents can become ＂excellent parents＂ to prove children with the necessary growth. Children are raised by same-sex couples, may not be conductive to personality development of the child, nor in the best interests of the child. Therefore, this article to explore the sexual orientation of the parents and personality development of the child is necessary to develop the relationship. To take the literature analysis method for analyzing the relevant literature and the court ruling in order to clarify the parents who are responsible for the protection of childcare, whose sexual orientation tends to determine whether the child plays a key role in determining the best interests of the child. Whether the parents can provide a good growth environment for the development of children's sound personality of core, the parents of sexual orientation is not the key. It is expected to construct a gender-consciousness and gender-friendly environment that will help the same-sex marriage to be falsified and recognize that status of ＂excellent parents＂ of the same-sex parents.
