台灣醫院的台灣專利申請行為之分析

Analysis of Taiwan Hospitals' Activities of Filing Taiwan Patent Applications

摘要

目標：我國專利法抑制醫院申請專利，但我國醫院仍有申請專利。醫院持有專利的現象是否將導致醫院間以專利訴訟做為競爭手段，此未受到公共衛生學界的關注。本文的目的在研究醫院申請專利的情況，以利於該問題的思考。方法:以智慧財產局的資料庫來收集醫院的專利申請資料。對資料的基本資訊或內容進行解讀，再提出醫院申請專利行為之觀察心得。結果：根據申請案數量和申請活動期間，將有申請專利的醫院分為主要、次要和一年申請人，並以表格來顯示申請各類專利的狀況。本文亦分析診斷類和治療類專利的申請狀況。最後，本文針對新型專利申請案分類，以暸解各醫院注重在哪類新型專利技術。結論：本研究主要發現為：（1）不到7%的醫院有申請專利；（2）長庚紀念醫院有較長的申請歷史；（3）國防醫學院的申請案總數最多；（4）多數醫院較少從事與診斷或治療有關的專利申請；（5）多數新型專利為病人照顧類；（6）醫院的等級可能和醫院的專利申請活動有關。

Objectives: The Patent Act inhibits hospitals from filing patent applications, but hospitals do file patent applications. Whether the situation of hospitals' acquiring patents will lead to patent litigation among hospitals as a competing measure is not a question the public health researchers in Taiwan have ever answered. The purpose of this article is to provide the information of patent-filing activities of hospitals which could be a basis for answering that question. Methods: The data of patent-filing of hospitals was collected from the database of the Taiwan Intellectual Property Office. Each patent document was analyzed by reading the basic information or content of the document. Then, some observations were provided. Results: Three tables were provided to show that three types of hospital applicant major applicants, minor applicants, and one-year applicants. The tables also showed their filing activities, such as filing history and the number of applications. Hospitals' patent applications for diagnosis and treatment were analyzed. Last, hospitals' utility model patent applications were categorized to understand the focus of each hospital. Conclusions: The main findings include: (1) Less than 7% of the hospitals in Taiwan have ever filed patent applications; (2) Chang Gung Memorial Hospital has a longer history of patent filing; (3) National Defense Medical Center has the highest number of applications; (4) Most hospital applicants rarely file a patent application related to diagnosis or treatment; (5) Most utility model patent applications are related to patient care; (6) The rank of a hospital may be positively related to its activity of patent filing.
