從老人福利法談我國老人保護相關法制

摘要

由於傳統民法、刑法並無針對老人之規範，我國即於1980 年制定了老人福利法，至今已發展成為老人權益保障之專法。關於老人保護之制度，筆者認為不應侷限於受虐、遺棄等議題，而應涵蓋機關權責、老人經濟安全、老人福利機構、老人保護及福利措施等面向，才能建構全方位的法律制度。本文即以老人福利法之規定為主軸，分析相關法制度及其衍生之法律問題。寫作設定對象為社會福利行政人員以及老人福利機構之專業人員，希望他們能多加充實法律知能，並且不至於迷失在規範叢林中。

Due to the civil law and criminal law aren’t regulated for the elders, the R.O.C government formulated the Senior Citizens Welfare Act in 1980. The Act has developed as a special law to protect the rights and interests of the elderly. However the author thinks the issues of elderly protections should not be limited on abuse and abandon, but also includes the authorities’ concerned, economic security, welfare institutions, protections and welfare measures to construct a full range of legal systems. The article is focus on the Senior Citizens Welfare Act, and analysis the legal issues and related. The article is also written for the staffs in the authorities, hope they can understand the legal system and will not confused.
