When the administrative agency becomes more powerful in the modern regulatory state, it is more likely that administrative acts invade citizens' rights. Scholars and administrative courts recognize that an individual whose right is in a dangerous situation may ask the court for an injunction against the Government for the administrative act to be made. The injunction is an effective remedy which prohibits illegal administrative acts, but its requirements are not clear. Last year, Supreme Administrative Court Judgment No. 2870 (2014) explained the requirements of injunction in detail. This paper analyses this judgment and discusses its implications and some potential problems.
