近來,如何防制洗錢與對抗資助恐怖主義已成為國際保險監理之重大議題。國際保險官協會已發布一系列文件指導會員國制定相關內國法規。金管會對此乃發布保險業防制洗錢及打擊資助恐怖主義注意事項加以因應。然而,系爭注意事項內容與保險法施行細則第4條第3項顯有牴觸,致生適用疑義。本文主張,可將系爭注意事項第4點第1項解為民法第71條「禁止規定」,藉此達成統合公法屬性之系爭注意事項與私法屬性之保險契約法之規範目的。
Anti-money laundering and combating the financing of terrorism, recently, have become burning issues of international insurance regulation. As a result, International Association of Insurance Supervisors has released Insurance Core Principle 22 (ICP 22) and related supervisory materials for the purpose of instructing members in enacting regulation. In response to the tide, Financial Supervisory Commission, R.O.C., launched Directions Governing Anti-Money Laundering and Countering Terrorism Financing of Insurance Sector (hereinafter the Directions). Nevertheless, two latent fissures pose a threat to the function of the Directions: on the one hand, the Directions’ position in hierarchy of sources of law is ambiguous; on the other hand, Paragraph 1 of Article 4 of the Directions is inconsistent with Paragraph 3 of Article 4 of Enforcement Rules for Insurance Act. This study argues that the Directions falls within the category of Regulation, which is authorized by laws. Also, Paragraph 1 of Article 4 of the Directions should trump Paragraph 3 of Article 4 of Enforcement Rules for Insurance Act.
