醫療糾紛的預防

Prevention of Medical Disputes

摘要


醫療照護結果的高度不確定性,加上近代民權思想的高漲,使醫療糾紛不斷增加,造成醫界與病人越來越重的困擾。本文探討台灣醫療糾紛的近況,古今醫界的各種自律條款的文獻,社會與病人對醫師的期盼,醫病關係的變遷,以及國內外醫療疏失的嚴重性,企圖重新喚醒醫界對愛的醫學倫理的注重,舉出醫師應注意的行醫準則,維持高品質的醫療服務,並呼籲病人重拾對醫師的信任態度,也要求法界從速訂定「醫療糾紛調處法」,以導正醫療糾紛回歸理性處理的風氣。

The result of medical care consists of high uncertainty. With the progress of modern democracy and human right, there is an enormous increase of medical disputes in recent years. This paper discusses the current status of medical disputes in Taiwan. Reviewing the old and current self-discipline statements of the medical society, the expectation of the lay society to the medical personells, the changing status of the physician-patient relationship, the great seriousness of the medical negligence, the author wishes to give suggestions to physicians to recall their love and ethics in the medical practice, to improve the quality of medical service. He also asks the patients to regain their trust in physicians. The law and government bodies are also urged to set up a better method to solve the serious problems of the medical disputes.
