國民教育階段學生管教法理之探究

The Study of the Legal Principles of Disciplines on Students in Compulsory Education

摘要


民主法治時代,教育工作應跳脫傳統威權體制窠臼,朝向尊重人權與人性尊嚴邁進,面對學生行為管教,除仰賴教師教育專業知能與素養,亦需重視法律性質與規範,使教師之教學自由與管教之專業自主權,建立在依法執行公務,使學生在學校體制潛移默化過程,維護與保障其基本權益,學習法治精神,實現教育目的。本文透過法理之探究與法制之分析,首先掌握教育法之核心精神,針對管教權進行法理之探究,以釐清管教之法理權責與法制原則,提出遵循合乎法理的管教原則。

In recent years, based on the development of democracy and rule by law, different education views impacted on the educational work field. Especially, the relationship between students and teachers has been dominated by law. The purposes of this study is to explore the legal principles of the teachers' disciplines right in compulsory education.This research adopts jurisprudential inquiry and legal analysis to confirm the core of education law, discuss the legitimacy of the teachers' disciplines right, and ravel out the duty and right on teachers' discipline, finally, probe the legitimacy principles.
