2006年中國人民銀行、中國銀行業監督管理委員會與國家外匯管理局聯合頒布「商業銀行開辦代客境外理財業務管理暫行辦法」,開放並規範商業銀行從事代客境外理財業務。在2007年,中國大陸之商業銀行並共推出262款代客境外理財產品,總銷售金額達414億元人民幣及12.5億元美元,商業銀行代客境外理財業務遂受到注目。由於中國大陸整體商業銀行之代客境外理財市場深具成長潛力,未來將成為我國銀行業進入中國大陸市場後必爭的重要市場,故其相關規範與市場發展值得研究與關注,據此,本文將就中國大陸之商業銀行代客境外理財的業務准入、投資匯兌管理、託管業務、產品投資範圍等相關規範及市場發展與問題等予以分析,並在結論中提出對我國銀行業進入該市場的策略建議。
In 2006, the People's Bank of China, China Banking Regulatory Commission, and State Administration of Foreign Exchange jointedly issued ”Rules of Commercial Banks Providing Overseas Financial Management Services” to regulate qualified domestic commercial banks operating overseas financial management for Chinese nationals and corporations. In 2007, The China's commercial banks have totally issued 262 overseas financial management products, and total sales of these products amounted RMB$ 41,4 billion and US$ 1.25 billion. The commercial banks overseas financial management services have been, therefore, gained much attention. Given the high growth potential of China's commercial bank overseas financial management market, this market will become an critical important market for Taiwanese banks after their entry into China market. Thus, the regulatory regime and market development of commercial banks overseas financial management services in China are deserved further studies. This paper will analyze rules of commercial bank overseas financial management services in the areas of market access, foreign exchange controls for investment quota, custody services, investment scope, as well as its market development and challenges. This paper will also provide strategic suggestions for Taiwanese banks in the conclusion.
