摘要

訴訟當事人不適格經常是敗訴的理由，運送人之確認是一個重要的議題，本文探討兩岸海商法及國際公約對於運送人有關的規定，並舉案例說明及析論正確辨識運送人的方法，並就列舉案例說明辨識方法之應用。

Ineligible or incorrect claimant or defendant is used to be the reason of rejection in judicial proceedings of a claim. This paper is to deal with the recognition of a carrier in a claim, the statement concerning a ”carrier” in the international conventions and Maritime Code of cross straits. There are also two cases taken as example and concluded with the guided directive to identify a carrier.
