摘要

電腦與網路對於我們現今日常生活中的地位已無庸贅言，其所帶來的，或許不能說是一種「進步」，但確實是重大的變更，且生活無處不與之結合。而隨著風險意識與風險社會概念的興起，立法者豎起資訊安全的大露，為避免電腦及其相關設備的濫用，也為防範社會與被害人的損失，將刑罰深入每一個與之有關的角落，極度擴張管制範圍，本文除了意圖觀察此一發展歷程，當然也以探討相關刑事立法為目的，檢視刑罰前置他與預防思維在其中的意義，並逐步討論刑法第三十六章妨害電腦使用罪之構成要件。不過，身處於資訊時代急速轉變中，似乎可以見到的方向是，思考資訊風險的議題，將會回到一個基本的出發點，亦即我們對於「人」及其生活世界的理解，是否已經有所轉換。

Needless to say, the Internet and concerned information technology take a pivotal role in daily life nowadays. It brings about something more than advances, but a significant change indeed. As the concept of risk awareness and risk society arises, the legislators put related behaviors into criminal punishment in order to avoid the abuse of computer and other devices and prevent the loss of the victims and mass public in terms of protection of information security. The article not only intends to observe the process of over-regulated development, but also explores the meaning of thoughts related to prevention and previously executed punishability. Furthermore, the article will discuss requisite elements of Chapter 36 Offenses against the Computer Security in Criminal Code. Nevertheless, while faced with drastic change in the technology era, we may return to a fundamental point-whether the understanding of ＂human beings＂ and their life world has altered.
