社會保險基金做為構成國家安定基金成員正當性之商榷

摘要

本文旨在從法正當性之理念，法律規範，制度面與實務面，探討社會保險基金做為國家金融安定基金成員的正當性問題。此一議題涉及社會公平正義理念，國家行為之憲法規範，法律制定與任務承諾信守，社會保險基金性質與任務設定，國安條例任務設定與實施，股市性質與結構變遷，社會保險基金管理專業準則與作為等多層面、多環節、多專業又具利益與政治性之複雜而重大之事項。基於現代民主法治國家法正當性要件之要求，社會保險基金之特殊性，法定任務與被保險人財產權自由運用與保護之限制，基金法定用途，以及國家干預可能產生之社會逆分配，資金套牢等後果，本文認為國家透過另外立法建立國家金融安定制度，將社會保險基金納為其護盤基金成員之一，參與股市動盪護盤之作為，並未以被保險人最佳利益為考量，違反社會保險基金管理與運用必須有利於基金收入者之前提要件。質言之，顯然不符合程序正當與實質正當之要求。本文認為應徹底改正此項缺失，修法免除國家對社會保險基金之干預，回歸社會保險基金專業管理之正常途徑，遵循基金管理安全性、收益性、流動性、福利性、社會性之管理規範優先順序要求，以維護被保險人長期基本生計維持需要之憑藉。

The aim of the paper is to review the legitimacy of the state intervention in recruiting social insurance funds to serve as joint members of the state financial security fund through the particular legislation of the Act of the Formation and Management of the State Financial Security Fund. The task of the state financial security fund is to save the crash of the stock market through its fund operation. The analyses of this study involve multiple issues, including the core value of the social justice, the idea and requirement of modem law, the principle of the rule of law, the nature of stock market, the essence and the goals of the social insurance funds, and the general management principles of the social insurance funds. The social insurance funds were set up for the specific purpose of guaranteeing the future benefit payments. After theoretical and practical analyses, this study has found that the state intervention in recruiting the social insurance funds are both illegitimate and unjust. Former Finance Minister Lee recognized this problem and planned to abolish this intervention, while the successive Minister only limited the reform to the time of applying stock market intervention. However, the basic drawbacks of the Act remain the same. Thus, this study suggests that the social insurance funds should be excluded as members of the state financial security fund.
