摘要

本文是以二戰後台灣法理學第一階段（至1990年左右）的發展狀況為研究對象，具體研究王伯琦、洪遜欣、馬漢寶、楊日然、林文雄五位學者的著作。第一部分是序論。第二部分藉由奎因「經驗主義的兩個教條」中的思考指出，奎因在挑戰「分析的」（analytic）概念時，同時推進了往實用主義哲學立場的發展方向，而本文所探討的這一段法理學發展史，隱隱顯示了一個非常類似的發展趨向。第三部分討論法理學的概念與範圍。第四部分討論分析哲學的影響。第五、六部分分別檢討各個學者立場與自然法論以及法實證主義的關係。第七部分處理實用主義思想在台灣法理學發展的地位。第八部分綜合檢討奎因的看法與法理學的關係，以及客觀形上學對法實證主義的檢討。最後是結論。

By studying the works of five scholars: Wang Bo-Chi (王伯琦), Shiun-Shin Hong (洪遜欣), Herbert Han-Pao Ma (馬漢寶), Rih- Ran-Zan Yang (楊日然), Wen-Shiung Lin (林文雄), I elucidate the first phase of post war development of legal philosophy in Taiwan in this paper. After the introduction, in second part, I explain the main point of this paper: the first phase development of Taiwan's post war jurisprudence showed some traces similar to Quine's thought in his Two Dogmas writing: the breakdown of the two dogmas of empiricism leads to pragmatism. From third to seventh parts, I discuss the domain of jurisprudence; the influence of analytic philosophy; the natural law theory; the legal positivism; and the pragmatism respectively. In the eighth part, I discuss the relation of Quine's epistemology to Taiwan's legal theory in general, and the critique of legal positivism raised by Prof. Hong's objective metaphysics. The last part is conclusion.
