This paper examines Rawls's idea of the original position, argues for a fine-tuning of that idea, and proposes a Confucian revision of the principles of justice as fairness. My argument also reveals a limitation of Rawls's approach to intractable value conflict and deep disagreement - namely, that it fails to detect, and thus pays no attention to, the fact that there are always self-defeating forces implicit in modern democratic processes. I argue for an idea of civic philosophy, and develop a Confucian version of civic philosophy, to overcome that limitation.
