論「兩岸治理」機制之建構:結構、路徑和制度化

Construction of Cross-Strait Governance Mechanisms: Structure, Path and Institutionalization

摘要


自2008年6月兩岸重啟協商迄今,一方面促進兩岸關係更開放更密切的交流,另方面也意味兩岸關係已經形成一種特殊的治理狀態。兩岸事務依靠各自政府單方的管理已很難回應未來的需求,應建立在「兩岸治理」的思維上才可能取得新的發展方向與空間。因此,本文擬探討「兩岸治理」機制之建構,從治理的觀點及理論內涵檢視和描述現階段的兩岸關係,並就結構、路徑和制度化三個層面對「兩岸治理」機制進行初步的探討與分析。研究發現,要建構「兩岸治理」機制須超越一些挑戰與困難:首先面臨最大的挑戰就是傳統的主權統治觀,兩岸應該揚棄用統治的觀念代之以治理觀點來處理問題,方能順利推動「兩岸治理」機制之建構。其次,由於兩岸公民社會發展的不對等,以致在兩岸治理中存在不均衡的問題,讓兩岸治理面臨結構性的發展困境。其三,兩岸治理制度化必須循序漸進地推動,暫先擱置政治性、軍事性議題,經由協議範圍逐步的擴大與深化,方能落實兩岸治理之制度化。

Since Taiwan and China have reentered negotiations in June 2008, results of these negotiations have on one hand promoted increasingly close cross-strait interactions, but on the other hand also mean that cross-strait relationships have formed a unique state of governance. Thus, this paper seeks to explore the construction of ”cross-strait governance” mechanisms, using the perspective and theoretical content of governance to evaluate the current cross-strait relationship. The three aspects of structure, path, and systemization are used to engage in initial exploration and analysis of ”cross-strait governance” mechanisms. Research results show that in order to construct ”cross-strait governance” mechanisms, some challenges and obstacles must be transcended. The first challenge is the traditional view of sovereign rule. Taiwan and China should abandon concept of governing, and use the view of governance to deal with problems to be able to promote construction of cross-strait governance mechanisms. Second, due to unequal development of civil society, there is the problem of imbalance causing structural developmental problems in cross-strait governance. Third, the institutionalization of cross-strait governance must progress sequentially, first tabling political and military issues to deal with affairs with practical attitudes, and sign various agreements. As the scope of agreements broaden and deepen gradually, it would be possible to fulfill the institutionalization of cross-strait governance.
