兩岸軍工產業管理法制之比較研究

A Comparative Study on the Management Legal System of Cross-Strait Military Industry

摘要


各軍事強國在面對國內的軍工產業轉型及提升效能時,均認為必須注入企業經營管理精神,故兩岸政府對本身軍工產業,也認為須在國家法制有效管理的架構下,注入企業化經營管理的模式,並創造相關法制,以作為政策執行的定性,如大陸推行的「軍工企業股份制」及我國推行的「國防工業行政法人化」等等。同時政府與軍工產業的「主從角色」必須調換,政府除於管理制度必須放權外,並要有效地執行監控,讓各個軍工產業熟悉適應國防市場的需求,遵守國防政策法令,才可獲取政府的國防利益,此時的政府始可取得最大的軍事投資價值效益,並創造雙贏的軍工產業政策制度。

When executing and upgrading the military-industrial transformation, militarily powerful countries think that must be filled with the spirit of enterprises operation management. The cross-strait governments think about the military-industrial management should be operated in the framework of the country's legal system. They may inject enterprises operation management mode and create the rule of law as the implementation of policies, such as the ”PRC military-industrial joint-stock company” and ”ROC military-industrial administrative corporation”.In the meantime, the government's management must be open, effective, and monitoring, so that the military-industrial complex can fit the needs of national defense market and comply with the decree of national defense policy. The government may also get the largest military investment value and create win-win policies and systems of military industry.
