摘要

本文透過論語及孟子等儒家經典的論述分析，特別著重於經典成書的歷史脈絡及對話者相互之間關係的詮釋，探討儒家在軍事倫理當中的軍人倫理與軍隊倫理這兩個面向，彌補傳統武德研究的理論缺口。研究結果發現，孔孟強調軍事行動必須要在仁義的規範下進行，脫離了仁義，軍事行動便失去合法性。同時非仁義的軍事行動雖然可以解決政治問題或國際紛爭，但恐怕會製造出更多的後遺症，不僅造成國家之間的對立，而且使國民也變得更功利。

The aim of this study is to construct am analysis of military ethics in accordance with Confucian view. In this study, I clarify first the ultimate end of military ethics in Confucianism through an analysis on its classics and argue that for Confucian view ethics requires equality in fulfilling all kinds of soldiers. The findings show that military operations must be implemented in benevolence and righteousness (仁義), if military action is out of benevolence and righteousness, it will lose its legitimacy. In the same time, the immoral military action may cause international opposition.
