摘要

1949年4月4日北美及歐洲成立了一個區域組織「北大西洋公約組織」，28個國家的國防部除了參與作業外，也組成「軍事委員會」，藉以統籌北約組織各項軍事事務的執行及任務分派，同時在國防工業合作的理念下，各國軍工企業也結合北約盟軍的建軍規劃及軍事行動，彼此互利競爭發展。同時北約盟軍也於2003年6月30日，由該軍事委員會第362-1號發布「北約交戰規則」，以其「法效性」文件，作為執行軍事行動的手段，並合於武裝衝突法原則規範的政策指導；又北約交戰規則均充分尊重國家軍隊的本身特有制度，所以在盟軍執行的利比亞「聯合保護行動」、科索沃「和平援助軍事行動」、地中海「積極軍事行動」、阿富汗「強制和平任務」、索馬利亞「海洋盾牌軍事行動」等重要軍事任務上，成功聯結北約各國「軍事指揮鏈」，形成另一種「軍事互信機制」。

North Atlantic Treaty Organization(NATO) was formed on April 4, 1949. The 28 nations' Department of Defense participated in the ”Military Committee”(MC), which co-ordinates the implementation of the NATO military affairs and task assignments. While, under the concept of defense industry cooperation, military enterprises are competing development to one another, the NATO Rules of Engagement (ROE, No.362-1) with enclosure was published by the Military Committee on June 27 03. The document, that is legal, effects as a means of operations, and its policy guidance also complies with the principles of law of armed conflict. The ROE successfully links to NATO's military chain of command among the Operation Unified Protector, a peace support operation in Kosovo, the Operation Active Endeavour, Afghainistan's peace-enforcement mandate, and the Operation Ocean Shield. This procedure forms another mode, called Confidence-Building Measures.
