摘要

移民法向來都是法學研究與實務的邊陲地帶，跨國婚姻與家庭甚難獲得司法實務與法學研究的關注，特別是在疫情影響下的入境管制更被理解為有效對抗疫情的不二法門。更有甚者，在夾雜國家與國族好惡下，使得外籍或陸籍的配偶與子女的入境團聚更顯複雜與困難。本文之作，旨在提醒：入出國及移民法制並非法外之地，其規範手段始終仍須符合法治國原則的要求。

Immigration law has always been in the peripheral area of legal research and practice. Issues related to transnational marriages and families have rarely received the attention from judicial practice and legal research. In particular, the border control measures reinforced under the influence of the COVID-19 are viewed as the only effective measure to prevent the spread of COVID-19. Furthermore, under the influence of the national preference and ethnic bias towards different nations, the family reunion with foreign national or Mainland China spouses and children becomes more and more complicated and difficult. This article serves as a reminder that issues related to immigration are not unregulated in that the Immigration Act must comply with the principle of rule of law.
