我國地方自治團體國政參與權之建構

摘要

地方自治團體得自行處理地方之自治事項，並負政策規劃與行政執行之責任，但如中央政府所制定之法律，又常涉及地方與中央共同協力辦理之事項。以致造成中央與地方權限劃分的爭議。為了解決上述問題，並尊重地方自治團體的自治基本權利，我國宜建構地方自治團體參與中央法律及重大政策之權。在我國地方制度法中宜增訂中央與地方政府，涉及共同辦理或共同協力之事項，建立地方參與國政參與的途徑。

Local self-government group shall handle local self-government items by themselves, and also carry the responsibilities of policy planning and administrative execution. But the laws established by central government are often involved with the cooperated items between local and central government. It causes the dispute in the division of powers between local and central government. In order to solve above mentioned problems and respect the fundamental rights of local self-government group, the competence shall be constructed for local self-government group to participate central laws and major policies in our country. In our self-governance law, the mutual processed and cooperated items between local and central government shall be revised and augmented in order to establish the approach for local government to participate national policies.
