本文以專利法學理為基礎,透過民法第184條以及第185條檢核新型專利「M427791具有乳酸菌之內餡與麵皮的組合體」,探討專利侵權迴避技術與方法,完成具有侵權迴避性之食品新型專利案報告。

This study is based on the principles of laws which include the Civil Code Section 184 and 185 for an inspection on the utility patent of "A combination of stuffing and dough with lactic acid bacteria" to investigate the techniques and methods on patent infringement avoidance as a food case report in patent infringement avoidance.
