本文針對一個一致性行為的案例【中油與台塑公告調價資訊案】,利用猜測變量模型,分析事前公告價格資訊對市場競爭的影響,希望能提供執法機關判斷交換訊息對市場競爭的影響,以及影響程度須達到何種標準,方具有競爭法上的非難性。

This article examines the CPC-FPCC price signaling case, in which two oil companies are indicted for concerted action. This paper uses a conjectural variation model to investigate the impacts of price signaling on market competition. It is hoped that this approach could help readers understand the impact of information-sharing on the market competition and the borderlines between lawful and unlawful conducts.
