The Lisbon Treaty was signed in the Portuguese capital by leaders of the EU's 27 member states in December 2007, and brought to an end to a six-year long European leaders' dispute with EU constitution. The Lisbon Treaty replaces The Treaty Establishing a Constitution for Europe (TCE), preserves the main substance of the constitution, and recognizes Charter of Fundamental Rights of the European Union of the same legal value as the Treaties. This essay attempts to analysis human rights protection in The Treaty of Lisbon based on Robert Alexy's theory in A Theory of Constitutional Rights.
