摘要

轉型社會能否在轉型正義的思維架構下，落實民主、人權與法治的現代立憲主義精神，乃近年有關轉型正義研究所關注的核心議題。本文擬從分析轉型正義的理念出發，探討該理念所涵蘊的內在價值，並且指出，落實轉型正義，將有助轉型社會的民主轉型、人權保障、和法治國原則的真正實現。本文另將藉由反思轉型正義所涉及的若干問題如集體責任、社會正義和善治等，綜合全文見解指出，雖然是為一門新興的研究領域，轉型正義所提供的思維進路與實踐方法，確實提醒我們，正義不是建立在浪漫的妄想上，而是必須藉由持續的反思、學習與實踐，才能真正體現其所頌揚的內在價值。

Can a transitional society produce the spirit of the modern constitutionalism of democracy, human rights and the rule of law under the cogitation framework of transitional justice? This has been the core issue at the heart of the study of Transitional Justice in the recent years. Starting from an analysis of the concept of transitional justice, this paper tries to explore the intrinsic value entailed in it, and points out that the implementation of this idea will help to facilitate the democratic transition, the protection of human rights, and the realization of the principle of rule of law in a transitional society. In addition, by way of reflection on some of the other questions such as collective responsibility, social justice and good governance, this paper will also conclude with an integrated opinion noting that, although still an emerging field of study, the considered approach to transitional justice and its mechanisms in practice indeed remind us, that justice is not built on a romantic vain hope, but rather can be sustained by our constant reflection, learning and practice.
