我國農地使用規劃與管理相關法律重點與問題分析

摘要

我國近年來農業經營條件出現巨變，兼以自二○○二年加入「世界貿易組織」(World Trade Organization)以來，使得農地使用面臨重大衝擊，尤其，「永續發展」已然成爲普世價值，規範農地使用之思維當不能置身度外，於是，如何於「生活、生產以及生態」三生主義之基礎上，合理規劃以及管制農地使用，即爲主管機關之重要課題，妥此，本文擬從法制觀點分析現行農地使用與管理相關規範並提出建議。論文內容之安排爲：一、序說：主要以研究動機、研究目的、以及研究方法爲重點；二、土地使用規劃理論與體制相關文獻概述；三、農地使用規劃與管理相關法律分析：主要在於旨揭三生主義之理念上，逢周歸納方式深究現行法制內容，並採總體法規（以區域計書法爲主）與個別法規（以農業發展條例爲主）之論述方法予以抽絲剝繭，企圖予以類型化並凸顯其問題所在，四、結語：本文強烈建請農業主管機關實應儘速「腹地使用變更法」，但於研擬過程中必須注意其與國土利用、環保及其他特別法規之競合，才能發揮確保護優良屋草地資源之功能。

Since our country as member of the ”WTO”, there are great challenge for the agricultural sector. The allocation of agricultural land resource shall be therefore reviewed. Meanwhile the ”sustainable development” is becoming an important task for the government. Based on changing of socioeconomic conditions as mention above, the mean point of this article is to explore the existing issues and to make suggestions for authority. The content of this paper can be demonstrated as follows. Chapter I includes the goal and method of the paper. Chapter 2 reviews the related literature. The main point of chapter 3 is to analyze the existing legal institution on use planning and management of agricultural land resource. At last, chapter 4 suggests proposals for use of agricultural land based on the legal institution aspect.
